Hawaii home rentals ruled exempt from 90-day change

U.S. District Judge Derrick Watson has issued a permanent injunction in favor of the Hawaii Legal Short-Term Rental Alliance, preventing the city from enforcing Ordinance 22-7, which sought to increase the minimum rental period for residential properties on Oahu to 90 days from 30 days. This decision protects existing home rental owners who were previously adhering to the 30-day minimum. The ordinance was challenged by the non-profit advocacy group HILSTRA, which argued that it caused significant harm to property owners and operators.

While the city is evaluating its legal options following the ruling, it has been enforcing other aspects of Ordinance 22-7, including the vacation rental registration and advertising requirements.

The city has also improved its enforcement capabilities and is evaluating proposals for a new portal to assist with compliance, enforcement, and applications for legal short-term rental operators.
